The kind of visa needed is defined by immigration law and relates to the intended purpose of your travel.

EMPLOYMENT VISAS

E3 Visa – This is a visa specifically for Australian passport holders to gain access to the US more quickly. You still need a job offer from a US employer for a suitable position but this means you can avoid the normal queues and visa capping that occurs for other countries. This is a real bonus for Australians and will ensure you’re working in the US as quickly as possible.

Intercompany Transfers / L visas – If a company based overseas has a branch in the USA or intends to establish one in the USA then this visa can be used to transfer key managers or technical specialists to the USA. This is a temporary residence visa that can be extended for up to 7 years. The employee to be transferred needs to have worked for the overseas company for a minimum of 1 out of the last 3 years.

BUSINESS VISAS

E1 or E2 Investor and Trader visas are available for applicants looking to invest or trade temporarily in the USA. Only certain passport holders are eligible as treaty trader & investors for these visas.

EB5 Investor Visa – This is a route to a green card or permanent residence straightaway. There have been some problems in the past with regards to the type of investment that qualifies and is safe for this program. FAMILY MIGRATION

If you have a family member or spouse that is a US permanent resident or citizen, then they may be able to sponsor you for a visa to the USA.
